At 5:33, Mr. Jewell asked Mrs. Robertson about the Workforce Investment Board, he wanted to know if Richmond was planning to pull out of the Regional Alliance because of the perception that Richmond was getting little return on it's investment. President Graziano said this was a topic better suited for a committee meeting, Mr. Jewell insisted it was important for constituents to know where they could go to look for work.

Part 1/ - Drainage Improvement Update - Land Use Committee - Jan. 17, 2012 - Richmond, Virginia from Silver Persinger.

Robert "Bob" Steidel [Director of Public Utilities] and Rosemary Green [Deputy Director, Technical Services, Dept. of Public Utilities] (pictured above) gave a presentation on the "South Kinsley and Leake Avenues Drainage Improvement Projects" to Council members Doug Conner, Ellen Robertson, and Marty Jewell.

During discussion of the first paper, I objected to Mr. Conner's intention to forward a paper to Council without opening the discussion to Citizen Comment. I asserted that Citizens are entitled to comment on all legislation that comes before the committee. When Mr. Conner called for a public hearing there was no one there to speech in favor or opposition to the paper, Ord. 2012-3 [Patrons: Conner & Robertson] City to donate $10,000 to the Partnership for Smarter Growth to assist in applying for a grant for the James River Branch Rail-to-Trails and Cannon Creek Greenway projects.

During the Citizen Comment Period, I raised the issue I have raised many times in the past that holding meetings at 3 PM, precludes 85% of working people from attending Committee meetings.

Pamela Porter [Real Estate Specialist, Dept. of Public Works] presented on a couple of papers dealing with cellphone companies leasing tower space. Another paper to requested the RMA install mile markers on the Powhite Parkway and the Downtown Expressway.

Part 4/5 - Discussion about Kanawha Plaza - Land Use Committee - Jan. 17, 2012 - Richmond, Virginia from Silver Persinger.

The last two papers for consideration were Resolution 2011-R165 and Ordinance 2011-206. Res. 2011-R165 would reverse a decision of the Commission of Architectural Review [CAR] which denied a Certificate of Appropriateness for the painting scheme of a home located at 402 N. Allen Ave.

Ord. 2011-206 would add a new section to the City Code concerning Kanawha Plaza removing the prohibition on camping, and allow the park to be open 24 hours a day. Currently all city parks prohibit camping and all parks close at sunset.

Charles Samuels [2nd District] introduced the resolution to overturn the Commission of Architectural Review's decision but requested he wanted to continue the paper 30 days.

Catherine Easterling, Secretary of CAR, informed the Committee that the Commission was planning to discuss the issue the following day.

Marty Jewell introduced Ord. 2011-206 with a ten-minute speech [6:00]. Representing Mayor Dwight Jone's administration, Carolyn Graham, Deputy CAO, Dept. of Human Service [17:38], Norman Merrifield, Director of Parks, Recreation, and Community Facilities [23:45], and Larry Miller, also from Parks and Rec. [24:41], spoke in opposition to the ordinance and argued that protracted camping in public space "would be problematic from a health and safety standpoint."

Alan Schintzius [28:04] and I, Silver Persinger [31:34], spoke in support of the paper. I offered an amendment that would require tents to be removed by 9 AM to prevent "visual blight" downtown. Thinking back on that now, I regret saying that. Perhaps, I was trying to accomodate the official position but realize now I was advocating a half-measure. Oh well, live and learn. I also talked about Occupy Richmond and other things.

After much discussion, Mr. Jewell proposed to continue his paper with amendments, though no specific amendments were proposed at the time [47:55].

Council President Kathy Graziano commented that this paper was not about Occupy Richmond, but was about allowing camping in the park [51:07].

Part 5/5 - Board Vacancies - Land Use Committee - Jan. 17, 2012 - Richmond, Virginia from Silver Persinger.

My Two Cents - Comment Period, Time of Meetings, Eggleston Hotel, Free Speech Park - Jan. 17, 2012 @ Land Use from Silver Persinger.

I spoke upon a range of issues at Richmond City Council's Land Use, Housing, and Transportation Standing Committee on Tuesday, January 17, 2012.

During discussion of the first paper, I objected to Mr. Conner's intention to forward a paper to Council without opening the discussion to Citizen Comment. I asserted that Citizens were entitled to comment on all legislation that came before the committee. When Mr. Conner called for a public hearing there was no one there to speak in favor or opposition to the paper, Ord. 2012-3 [Patrons: Conner & Robertson] City to donate $10,000 to the Partnership for Smarter Growth to assist in applying for a grant for the James River Branch Rail-to-Trails and Cannon Creek Greenway projects.

During the Citizen Comment Period, I raised the issue I have raised many times in the past that holding meetings at 3 PM, precludes 85% of working people from attending Committee meetings. [2:41]

I spoke in opposition to Ord. 2011-211, a Special Use Permit for the Eggleston Hotel project in Jackson Ward by developer Kelvin Hanson. My opposition is based in Council's disregard for the Planning Commission's recommendations, the lack of parking spaces the developer will have to provide, and that this paper is being rushed through with lack of public input. [4:31]

Also notable is that the biggest supporter of the project, Ellen Robertson, has not yet disclosed that she has received $1000 cash campaign contribution from the developer in 2004. I feel she should recuse herself from the discussion and the vote. I feel that she hasn't because it would appear "unseemly."

Finally, I spoke in support of Mr. Jewell's paper, Ord. 2011-206, to allow Kanawha Plaza to be a 24 hour park for free speech and camping [7:46]. I expressed my concern that it could lead to a permanent encampment, as a compromise I offered that tents should be removed daily by 9 AM. I went on to talk about my participation with Occupy Richmond, invited Council members to attend a General Assembly, and told them I felt like "a part-time slave" because "I need money to exist."

Council's First Meeting of the Year - Tragic, Humorous, & Corrupt

The first Formal meeting of the new year was very unique for a number of reasons. First, it was my first meeting back, after taking the year 2011 off from attending Council meetings. Though last year I probably attended at least 6 Council meetings.

Another unique quality was that most of Council's "unusual regulars" were there, including myself, Luis Pantophlet, Donald Hatcher, Melvin Jones, Tony Benony Amekudzi, Ruby Turner, Teddy Parham, Chris Dorsey, and Ms. Jones. The only folks missing were Irene Jennings and Charles Hughes, Sr.

It was also Richmond Times-Dispatch reporter Will Jones last time attending Richmond City Council as a reporter. He got a new job in Henrico County's Public Relations and Media Services Department. You can watch the Council send off in Part 5 below at 8:44.

As is customary, the meeting opened with a prayer spoken by Jason Helmlinger from The Richmond Outreach Center [ROC], followed by the Pledge of Allegiance, and Chamber Evacuation instructions.

Part 2/7 - Awards, Amending Agenda - Jan. 9, 2012 - Richmond, Virginia from Silver Persinger.

Thomas Haynesworth [pictured above] was given an award by the Council because he had recently been released from prison after serving 27 years in prison for crimes he did not commit. DNA evidence was used to prove his innocence.

From truthinjustice.org:

"For 25 years, Thomas Haynesworth of Richmond, VA said he was not the man who raped a church day-care worker at knifepoint. "Nobody ever listened to me," he complained. They're listening now. Thanks to the late Mary Jane Burton, a crime lab worker who kept small samples of DNA evidence in the files she worked on, Thomas has been excluded as the assailant, and the real rapist has been identified.

The foregoing news account was published on March 19, 2009. As of February 2, 2011, Thomas Haynesworth was still in prison. DNA proved him innocent of most of the rapes he was convicted of committing, and even one of which he was acquitted. But there were two rapes with no physical evidence, nothing to test. Finally, freedom is in sight.

UPDATE: March 18, 2011 - The Parole Board has voted to release Thomas Haynesworth on parole. His actual innocence petition is still pending before the Virginia Court of Appeals."

Ken Cuccinelli, General Attorney or the Commonwealth of Virginia was present and also received an award. Cuccinelli was instrumental in helping get Thomas Haynesworth out of prison.

The third award was presented to Big Brothers Big Sisters of Greater Richmond & Tri-Cities.

Part 3/7 - Regular Agenda - Jan. 9, 2012 - Richmond, Virginia from Silver Persinger.

There was only one paper on the Regular Agenda and it was amended and continued.

Ord. 2011-211 [Patron: Mayor Jones, By Request] - To authorize the special use of *** 535½, 537 and 541 North 2nd Street for the purpose of waiving parking, building height, maximum residential floor area and setback requirements for the construction of a mixed-use building with up to 31 dwelling units and uses permitted in the underlying zoning district.

There was an unusual procedural incident that occurred during the discussion of the amendment. At the Informal Session earlier in the day, the original amendment had been discussed. I assume it had been crafted by the City's Planning Department to address issues that the Planning Commission had with the project proposed for the Eggleston Hotel site by developer Kelvin Hansen.

Council discussed the item for 25 minutes, then killed the proposed amendments from the Planning Commission, and supported their own amendments which Council had only created a few hours before the meeting. In all of their discussion they never opened the debate to the public even though they were VOTING. I felt that it was very wrong for the Council to assert their preference on the issue, essentially ham-stringing the public's ability to support the amendments proposed by the Planning Commission by only offering the Council's preferred amendment in the upcoming Land Use Committee meeting.

Ellen Robertson [pictured above] spoke in support of the project [14:46] for nearly six minutes and never once mentioned she had received a $1000 cash campaign contribution from the developer, Kelvin Hanson in 2004. I think she should recuse herself from the final vote and discussion. This is an example of how even relatively small amounts of money have a questionable effect on our government.

Here's the differences between the amendments proposed by the Planning Commission and the Council.

Planning Commission's Amendments, which were killed by a vote of the Council with no opportunity of Citizen Comment.
• Waives parking requirements for permitted commercial uses. It was stated that there might be a restaurant "hopefully Croaker Spot" that could accomodate 100 people.
• Require 1 parking space for each unit, for a total of 31 for a projected 37 bedrooms.
• Allow for 23 of the spaces to be located within 1000 feet of the property. Within 300 feet is the normal requirement.
• Require use of Brick Veneer where currently the plan calls for Fiber Cement Panels.

Vandals have been breaking neighbors' car windows and throwing bricks and bottles through windows of people's homes, and gunfire can be heard every night. 7:37

Ben Loomis, Board member of the Assembly of God, complained about drainage problems near his church. It is contributing to problems with flooding, snakes, mosquitos, and rodents. 15:34

Teddy Parham told Council local companies were ripping people off. Companies she cited included Capitol Oil, Elderhomes, and the Salvation Army. She described a program operated by the Salvation Army where they collect trees that fall on city property and distribute wood to help people heat for the winter. 22:33

Chris Dorsey said the government at every level is not serving people. He said government is serving the interests of the Federal Reserve, the Bank for International Settlements, and Dominion Power. Bruce Tyler [1st District] spoke to anchor/reporter Kerri O'Brien from WRIC 8News about an ordinance patroned by himself and President Graziano to cap the expenditure on public art for any project at $250,000 instead of "1% for Art" program established by Ord. 97-3-41 adopted on Jan. 27, 1997. At the end of the interview O'Brien asked about a similar paper introduced by Graziano that proposed the cap at $100,000.
